Trump banned birthright citizenship. Can he do that?

Democrats have sued to block President Donald Trump's cancellation of birthright citizenship — setting up a much-needed legal battle to settle the issue once and for all.

What is birthright citizenship? Section 1 of the Fourteenth Amendment states: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

Historical context: The 14th Amendment was enacted in 1868 to prevent Confederate states from denying former Black slaves the privileges of citizenship — not to grant blanket citizenship to any newcomer who gives birth in the United States.

The order: On his first day in office, President Trump signed an executive order titled "Protecting the Meaning and Value of American Citizenship,” affirming that birthright citizenship is not extended to persons born to parents in the United States illegally or on temporary visas.

• His order is scheduled to go into effect on February 19.

Democrats sue: Lawsuits were filed by 22 Democrat states and immigration rights groups against the Trump administration, claiming the order violates the U.S. Constitution.

Zoom out: In 2022 alone, there were roughly 255,000 births to illegal aliens.

Abuses: Rep. Tom Tiffany highlighted one of the many abuses of the United States' current interpretation of birthright citizenship, writing on X:

• “President Trump was right to end birthright citizenship. Communist China has exploited this loophole by having women travel to the Northern Mariana Islands to give birth, securing U.S. citizenship for their children. It’s a national security threat, and it must end.”

What happens next? Today, a federal judge in Seattle will hear a lawsuit attempting to block Trump's order, kicking off what will be a long legal battle. This is only the beginning.

Trump fights the culture war with his pen

President Donald Trump issued a slew of executive orders in his first 48 hours in the White House — taking aim at a range of cultural policies embedded in the federal bureaucracy.

The details: On Wednesday, President Trump signed executive orders targeting “diversity, equity, and inclusion” (DEI), affirmative action, and the use of alternative flags on federal buildings.

DEI Programs: Trump eliminated federal DEI programs, closed related offices, put employees on leave, and recommended investigations into corporations and institutions promoting DEI.

Affirmative Action: Trump revoked a 1965 order requiring affirmative action for federal contractors, pushing a merit-based hiring framework instead.

One Flag Policy: Trump’s “One Flag Policy” bans non-U.S. flags, including Pride and BLM flags, from federal buildings and embassies, emphasizing neutrality. Exceptions include POW and detainee flags.
