Welcome back, Wake Up Right fam! Less than a week after riding high from their off-year election victories, Democrats are back at each other’s throats this morning after eight left-wing Senators defied Chuck Schumer and voted with Republicans to reopen the government. We’ll get into the details below, but for a quick taste of the vibes in D.C. today, check out these headlines:

Democrats blink first

A 40-day government shutdown broke wide open Sunday as eight Senate Democrats crossed the aisle and handed Republicans the votes to reopen the government.
The details: The Senate voted yesterday to move forward on a continuing resolution (CR) that would reopen the government through Jan. 30, 2026.
The Democrats who crossed the aisle were Senators Angus King (ME), John Fetterman (PA), Catherine Cortez Masto (NV), Jeanne Shaheen (NH), Maggie Hassan (NH), Jacky Rosen (NV), Tim Kaine (VA), and Majority Whip Dick Durbin (IL).
What was the beef? It essentially boiled down to Democrats wanting to extend Obamacare tax credits to the wealthy.
While Republicans wanted a simple extension of spending at current levels, Democrats insisted that any funding deal include the extension of COVID-19-era Obamacare subsidies, which are set to expire at the end of the year.
Republicans argue that the subsidies require separate consideration because, in their current form, they lack sufficient guardrails – even allowing the ultra-wealthy to receive the tax breaks.
What they’re saying: Democrat Rep. King said after "almost seven weeks of fruitless attempts" to get the tax credits, it was time to end the shutdown.
Political pressure: With over 10,000 flights delayed on Sunday alone and SNAP food stamp benefits for low-income Americans in limbo, the pressure had been mounting on Democrats and the Senate to end the shutdown.
Angry Democrats: Party leaders railed against the moderates who voted with Republicans.
Senator Bernie Sanders said: "If Democrats cave on this issue, what it will say to Donald Trump is that he has a green light to go forward toward authoritarianism. And I think that would be a tragedy for this country."
Ezra Levin, the co-founder of Indivisible, a leading left-wing activist group, said: "We cannot afford a divided and weak opposition party."
Zoom out: This forty-day shutdown was the longest in U.S. history.
The numbers: A review of ABC, CBS, and NBC news programming found that 87% of its shutdown coverage favored Democrats.
What happens next: The Senate must first finalize the deal and send it to the Republican-controlled House for a vote before it heads to President Trump's desk.
On the Obamacare subsidies, Majority Leader John Thune promised Democrats a December vote that needs 60 votes to pass [in other words, it’s likely dead on arrival].

School loses fight to force kids to use trans pronouns

A federal appeals court delivered a landmark First Amendment win Thursday, ruling that an Ohio school district cannot force students to use transgender classmates’ preferred pronouns.
The details: The Sixth Circuit, in a 10–7 ruling, found that Olentangy Local School District’s anti-harassment policy violated students’ constitutional rights by requiring them to affirm gender identities they do not believe in or risk suspension and expulsion.
In its majority opinion, the court said public schools cannot “wield their authority to compel speech or demand silence” on ideological matters.
What they're saying: Defending Education, which brought the lawsuit, called the ruling a "resounding victory" for student speech and parental rights.
School district tries and fails workaround: The district attempted to moot the case by altering its policy, but the court rejected the effort and issued a full, binding ruling.
Big picture: This ruling now sets a sweeping precedent across the Sixth Circuit boundaries, which cover Kentucky, Michigan, Ohio, and Tennessee.
The last word goes to the court, which wrote:
“Over hundreds of years, grammar has developed in America without governmental interference. Consistent with our historical tradition and our cherished First Amendment, the pronoun debate must be won through individual persuasion, not government coercion. Our system forbids public schools from becoming ‘enclaves of totalitarianism.’”
