Swamp protects swamp

A Clinton-appointed federal judge just tossed the indictments against former FBI Director James Comey and New York Attorney General Letitia “Big Tish” James on a technicality – giving them a temporary reprieve, but the Trump Justice Department is doubling down.

The details: U.S. District Judge Cameron McGowan Currie dismissed the cases Monday — NOT because the charges lacked merit, but because she claims that interim U.S. Attorney Lindsey Halligan was improperly appointed when she filed the charges.

• Currie’s 29-page ruling concluded Halligan’s appointment violated 28 U.S.C. § 546, which limits interim U.S. attorney appointments to 120 days unless a judge – not the attorney general [Pam Bondi] – selects the replacement.

Is it over? No. Currie tossed the case without prejudice, meaning prosecutors can return with a validly authorised indictment.

Back up: Comey had been indicted for false statements and obstructing Congress — charges rooted in his handling of Trump-era leak investigations. James was indicted for mortgage fraud.

What happens now? DOJ officials say they’re appealing. Former DOJ Chief of Staff Chad Mizelle called the ruling “wrong” and emphasized that senior DOJ leadership — including the attorney general — had ratified the indictments.

• AG Pam Bondi confirmed the DOJ will appeal, saying: “We’ll be taking all available legal action, including an immediate appeal, to hold them accountable.”

Big picture: The ruling doesn’t clear Comey – it just pauses the prosecution. If the DOJ wins on appeal, both indictments could snap back quickly. If it loses, Trump’s DOJ may need to re-indict Comey from scratch under a properly installed U.S. attorney.
