Supreme Court poised to undo race-based redistricting

The Supreme Court appears ready to rein in decades of race-based redistricting – a move that would rebalance state election maps nationwide, likely in favor of Republicans.

Let’s set the table: Louisiana v. Callais examines whether Louisiana's redrawn 2024 congressional map – where lawmakers were forced to create a second majority-Black U.S. House district – violated the Constitution.

The law: There are two laws at odds in this case:

• The left cites Section 2 of the 1965 Voting Rights Act (VRA), which prohibits voting rules or maps that “dilute” the voting power of racial or language minorities.

• The right says the VRA violates the Equal Protection Clause of the 14th Amendment by prioritizing race over traditional districting principles.

The details: During arguments on Wednesday, Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch pressed whether Section 2 can ever justify race-sorting in Congressional maps.

• Justice Brett Kavanaugh suggested that while the race-based fixes may be necessary at times, “they should not be indefinite and should have a[n] end point.”

• The three liberals on the court voraciously defended the race-based maps.

• Justice Amy Coney Barrett echoed some of the concerns cited by the conservatives, but she and Chief Justice Roberts are the wild cards here.

Embarassing side note: Justice Ketanji Brown Jackson drew criticism yesterday for her childish inability to contain her bias during oral arguments, even at one point referring to Black Americans as “disabled.” Her full quote:

• “Congress said, the facilities have to be made equally open to people with disabilities if readily possible [through the Americans with Disabilities Act]. I guess I don’t understand why that’s not what’s happening here. The idea in Section 2 is that we are responding to current-day manifestations of past and present decisions that disadvantage minorities and make it so that they don’t have equal access to the voting system. Right? They’re disabled.”

What’s next? Decisions from October arguments typically land by late June 2026.

Big picture: If Section 2 is weakened or gutted, Republicans could redraw maps more aggressively before the 2026 midterms and pick up as many as 19 seats in the U.S. House.
